Anyone who could have undertaken obligation independently via conducting legal affairs has the capacity to petition for deliberation.Anyone without capacity to petition for deliberation shall be represented by his/her legal representative.Matters concerning the legal representation in a deliberation case shall be subject to the Civil Law.

能獨立以法律行為負義務者，有復審能力。
無復審能力人應由其法定代理人代為復審行為。
關於復審之法定代理，依民法之規定。
