Where a court, in deliberating on a motion for a declaration of commencement of assistance, considers it necessary to subject the person concerned to a declaration of commencement of guardianship, it may, upon motion by the parties or on its own initiative, make a ruling of declaration of commencement of guardianship.Provisions in Article 174, Paragraphs 2 and 3 of this Act shall apply, mutatis mutandis, to the making of the court ruling in accordance with the preceding paragraph.

法院對於輔助宣告之聲請，認有監護宣告之必要者，得依聲請或依職權以裁定為監護之宣告。
