Juvenile Justice Act Article 36-1

The juvenile court may summon the victim, his/her statutory agent, or a person who currently protects the victim to be present on the hearing date and they shall be given opportunities to make statements. The preceding shall not apply to situations where a summons has been duly sent but the relevant persons fail to be present without justifiable cause, where they have stated their unwillingness to be present, or where the juvenile court deems their presence unnecessary or will be detrimental to the juvenile's healthy self-development.Taking of statements of the victim, his/her statutory agent, or a person who currently protects the victim provided for in the preceding paragraph may be done by the juvenile court, alternatively, during the conducting of the investigation.Where the victim is present on the hearing date in accordance with the preceding two paragraphs, with the consent of the victim, his/her spouse, direct blood relatives, collateral relatives within the third degree of relationship, his/her parent, family members, physicians, psychologists, counselors, social workers, or individuals he/she trusts may accompany him/her and be given opportunities to make statements. The preceding shall not apply to situations where the juvenile court deems that their presence will potentially disrupt the normal moving of the proceedings or will be detrimental to the juvenile's healthy self-development.The juvenile court, when deems it necessary after assessing the specific circumstances of the case, the respective physical and mental conditions of the victim and the juvenile, and hearing the statements made by the victim, the juvenile, and other parties present, may order the juvenile, his/her statutory agent, or a person who currently protects the juvenile not to be present on the hearing date and instead participate the proceedings behind a single-side mirror, through technological devices that carry two-way audio or video transmission, or with other appropriate isolation measures. The victim, his/her statutory agent, or a person who currently protects the victim may inquire to the juvenile court about the progress of the investigation or trial. Where the juvenile court deems it inappropriate to disclose the relevant information, it shall reply so to the inquiring parties.
