If the whereabouts of the person to whom the confiscated objects should be returned is unknown, or if the confiscated objects cannot be returned for other reasons, the prosecutor should make a public announcement. If after two years from the date of announcement no one claims the return, the confiscated objects shall be turned over to the National Treasury.Worthless objects, despite being within the holding period as described in the preceding paragraph, may be discarded; objects that are difficult to be kept in custody will be sold by a court order, from which the proceeds shall be kept in custody.

扣押物之應受發還人所在不明，或因其他事故不能發還者，檢察官應公告之；自公告之日起滿二年，無人聲請發還者，以其物歸屬國庫。
雖在前項期間內，其無價值之物得廢棄之；不便保管者，得命變價保管其價金。
