(Withdraw a Motion for Retrial and its Effect)A motion for retrial may be withdrawn before the retrial judgment.A person who withdraws a motion for retrial may not use the same reason to file a motion for retrial.

再審之聲請，於再審判決前，得撤回之。
撤回再審聲請之人，不得更以同一原因聲請再審。
