(Measures against Illegal Interlocutory Appeals by Court of Interlocutory Appeal)The court of interlocutory appeal shall overrule an interlocutory appeal by ruling if it satisfies the former part of Paragraph 1 of Article 408; provided that where the deficiency is amendable but not ordered an amendment by the original trial court, the presiding judge shall order an amendment to be made within a prescribed period.

抗告法院認為抗告有第四百零八條第一項前段之情形者，應以裁定駁回之。
但其情形可以補正而未經原審法院命其補正者，審判長應定期間先命補正。
