(Jurisdiction for Appeal Waiver or Withdrawal)A waiver of appeal rights shall be filed to the original trial court.An appeal withdrawal shall be filed to the appellate court; provided that it could be filed to the original trial court before dossier of the case are handed over to the appellate court.

捨棄上訴權，應向原審法院為之。
撤回上訴，應向上訴審法院為之。
但於該案卷宗送交上訴審法院以前，得向原審法院為之。
