The seized property which has not been ordered to be confiscated shall be immediately returned, provided that during the period allowed for appeal or while an appeal is pending, the seizure may remain in force if necessary.Note: Articles 1 through 343 were amended lastly on February 6, 2003.

扣押物未經諭知沒收者，應即發還。
但上訴期間內或上訴中遇有必要情形，得繼續扣押之。
