Judgment of "Exempt from Prosecution" shall be pronounced if one of the following circumstances exists:A final judgment has already been given;The period of statute of limitation is completed;There is already been an amnesty;A law enacted after the commission of an offense abolishes the punishment.Note: Articles 1 through 343 were amended lastly on February 6, 2003.

案件有左列情形之一者，應諭知免訴之判決：

三、曾經大赦者。
