If a search or seizure is executed in an occupied or guarded dwelling or other premises, the occupant, watchman, or his representative shall be ordered to be present; in their absence, a neighbor or an official of a nearby self-governing body may be ordered to be present.Note: Articles 1 through 343 were amended lastly on February 6, 2003.

在有人住居或看守之住宅或其他處所內行搜索或扣押者，應命住居人、看守人或可為其代表之人在場；如無此等人在場時，得命鄰居之人或就近自治團體之職員在場。
