Public Defender Act Article 7

The appointed public defender of district courts and branch courts must be with one of the following qualifications: 1. Passed the Public Defender Test. 2. With the qualification of a judge of district courts or branch courts, or, with the qualification of a public prosecutor of the prosecutor's office in the district courts or branch courts. 3. Passed the Bar Test and with over three years of practice in law outstandingly and with a qualification of intermediate level of civil service system. 4. Passed Military Judge (including Military Prosecutor) Test and assumed the position of military judges or prosecutors with intermediate level of civil service system for over four years outstandingly. The public defender rules are stipulated by Judicial Yuan.
中文原文 公設辯護人條例第7條
地方法院及其分院公設辯護人應就具有左列資格之一者任用之：
一、經公設辯護人考試及格者。
二、具有地方法院或其分院法官，地方檢察署或其檢察分署檢察官任用資格者。
三、經律師考試及格，並執行律師職務三年以上，成績優良，具有薦任職任用資格者。
四、經軍法官考試及格，並擔任相當薦任職軍法官四年以上，成績優良者。
公設辯護人管理規則，由司法院定之。
一、經公設辯護人考試及格者。
二、具有地方法院或其分院法官，地方檢察署或其檢察分署檢察官任用資格者。
三、經律師考試及格，並執行律師職務三年以上，成績優良，具有薦任職任用資格者。
四、經軍法官考試及格，並擔任相當薦任職軍法官四年以上，成績優良者。
公設辯護人管理規則，由司法院定之。
