Code of Civil Procedure Article 95
The provisions of this section shall apply mutatis mutandis to cases where the court, by ruling, concludes the case or to issues irrelevant to it.If there is no counterparty in the matter of motions or statements, unless otherwise provided, the litigation costs shall be borne by the movant or declarant.
