Code of Civil Procedure Article 90

Where an action is concluded without a decision, the court shall decide on the responsibility for litigation expenses by ruling on a motion.The motion referred to in the preceding paragraph shall be made within three months after knowing or being notified of the conclusion of the litigation.The provisions of Articles 81, 82, 91, and 93 shall apply mutatis mutandis to the situation in the first paragraph.
