Code of Civil Procedure Article 81
The court may, in its discretion, order the prevailing party to bear the litigation expenses incurred in full or in part for the following:1.An act performed by the prevailing party which is unnecessary for asserting or defending its rights;2.An act performed by the defeated party which is necessary for asserting or defending its rights in accordance with the phase of the proceedings reached at the time.

因下列行為所生之費用，法院得酌量情形，命勝訴之當事人負擔其全部或一部：
一、勝訴人之行為，非為伸張或防衛權利所必要者。
二、敗訴人之行為，按當時之訴訟程度，為伸張或防衛權利所必要者。
