Code of Civil Procedure Article 64
With the consent of both parties, the intervener may assume the action on behalf of the supported party. When the intervener assumes the action, the supported party will be deemed to have withdrawn from the action. The judgment of the action will have binding effect upon the withdrawing party.

參加人經兩造同意時，得代其所輔助之當事人承當訴訟。
參加人承當訴訟者，其所輔助之當事人，脫離訴訟。
但本案之判決，對於脫離之當事人，仍有效力。
