Code of Civil Procedure Article 398
A final judgment becomes binding upon the expiration of the period of time for taking an appeal from a judgment. Notwithstanding, a timely appeal taken from a final judgment in conformity with the law shall prevent that judgment from becoming binding.A final judgment from which no appeal may be taken becomes binding upon its announcement, or, if it is not announced, upon its publication.

判決，於上訴期間屆滿時確定。
但於上訴期間內有合法之上訴者，阻其確定。
不得上訴之判決，於宣示時確定；不宣示者，於公告時確定。
