Code of Civil Procedure Article 34
A motion for the disqualification of a judge shall be filed in the court to which such judge is assigned, stating the specific grounds for the motion.A preliminary showing of the grounds of the motion and the facts of disqualification provided for in the second paragraph of the preceding Article shall be made within three days of filing the motion.The judge for whose disqualification is sought may respond to the motion.

聲請法官迴避，應舉其原因，向法官所屬法院為之。
前項原因及前條第二項但書之事實，應自為聲請之日起，於三日內釋明之。
被聲請迴避之法官，對於該聲請得提出意見書。
