Code of Civil Procedure Article 321
The court may order a party to vacate the courtroom during a witness?testimony when it determines that a witness cannot make statements freely in front of a party. Notwithstanding, after the witness finishes his/her statements, the presiding judge shall call back the party and inform him/her of the nature of the statements.Where the court determines that a witness cannot make statements freely in front of a specific person attending the session, it may order that person to vacate the courtroom when the witness makes statements.

法院如認證人在當事人前不能盡其陳述者，得於其陳述時命當事人退庭。
但證人陳述畢後，審判長應命當事人入庭，告以陳述內容之要旨。
法院如認證人在特定旁聽人前不能盡其陳述者，得於其陳述時命該旁聽人退庭。
