Code of Civil Procedure Article 263
An action dismissed voluntarily is deemed an action never initiated. Notwithstanding, no voluntary dismissal of the plaintiff's claim will render a counterclaim inoperative. An action may not be re-initiated if it is dismissed voluntarily after a final judgment has been entered.
