Code of Civil Procedure Article 177
The court shall investigate on its own initiate whether a motion for the assumption of an action is meritorious.A court finding the motion without merit shall deny the motion by a ruling.When the proceeding is automatically stayed after the decision has been served, the court rendering the decision shall determine a motion for the assumption of an action.

承受訴訟之聲明有無理由，法院應依職權調查之。
法院認其聲明為無理由者，應以裁定駁回之。
訴訟程序於裁判送達後當然停止者，其承受訴訟之聲明，由為裁判之原法院裁定之。
