The court with judicial power at the time of prosecution shall not be affected by the facts and legal status change after pending legal actions. Once the case is pending at the court, the parties may not seek prosecution by a court with different judicial power for the same case.When a court determines that it has judicial power and its judgment has been established, other courts are bound by the judgment regarding the determination of judicial power.

起訴時法院有審判權者，不因訴訟繫屬後事實及法律狀態變更而受影響。
訴訟已繫屬於法院者，當事人不得就同一事件向不同審判權之法院更行起訴。
法院認其有審判權而為裁判經確定者，其他法院受該裁判關於審判權認定之羈束。
