The Banking Act of The Republic of China Article 52
A bank is a juridical person. Unless otherwise provided by law or with special approval obtained prior to the enforcement of the amendment to this Act, a bank’s organization shall only be in the form of a company limited by shares.A bank’s shares shall be publicly issued unless otherwise approved by the competent authority.The incorporation standards for banks or other financial institutions incorporated in accordance with this Act or other laws shall be prescribed by the competent authority.

銀行為法人，其組織除法律另有規定或本法修正施行前經專案核准者外，以股份有限公司為限。
銀行股票應公開發行。
但經主管機關許可者，不在此限。
依本法或其他法律設立之銀行或金融機構，其設立標準，由主管機關定之。
