Securities Investor and Futures Trader Protection Act Article 34

When the protection institution, pursuant to Article 28, institutes an action and moves for a provisional injunction or a provisional attachment, it shall make a preliminary showing of the claim and the ground for the provisional injunction or provisional attachment.A court may rule that a motion filed by the protection institution under the preceding paragraph be exempted from the requirement for the provision of security.
