Senior Citizens Welfare Act Article 39
Elderly welfare institutions shall maintain public liability insurance and demonstrate financial capacity to fulfill operational responsibilities, in order to protect the rights and interests of service recipients.The scope and amount of insurance required under the preceding paragraph shall be determined by the central competent authority in consultation with the relevant central industry competent authority.The criteria for determining the financial capacity mentioned in Paragraph 1 shall be prescribed by the municipal and county (city) competent authorities.

老人福利機構應投保公共意外責任保險及具有履行營運之擔保能力，以保障服務對象權益。
前項應投保之保險範圍及金額，由中央主管機關會商中央目的事業主管機關定之。
第一項履行營運之擔保能力，其認定標準由所在地直轄市、縣（市）主管機關定之。
