Drug Injury Relief Payment Standard Article 4
When an application for relief payment from a drug-related injury is reviewed and reasonably determined to have been caused by adverse drug reactions, the amount shall be paid according to the following levels of disability. After the review, where the cause of disability cannot be reasonably attributed to other reasons, the relief shall be paid up to the maximum amount specified below:1. Profound disabilities: The maximum shall be paid for NT$3,000,000.2. Severe disabilities: The maximum shall be paid for NT$2,250,000.3. Moderate disabilities: The maximum shall be paid for NT$1,950,000.4. Mild disabilities: The maximum shall be paid for NT$1,750,000.The disability identification levels set out in the previous paragraph are those announced by the Ministry of Health and Welfare.

申請藥害救濟案件，經審議可合理認定為因藥品之不良反應致障礙者，依下列障礙程度給付；經審議無法合理認定有其他原因致身體障礙者，於最高額度內，酌予給付：
一、極重度障礙：最高給付新臺幣三百萬元。
二、重度障礙：最高給付新臺幣二百二十五萬元。
三、中度障礙：最高給付新臺幣一百九十五萬元。
四、輕度障礙：最高給付新臺幣一百七十五萬元。
前項障礙等級，依衛生福利部公告之身心障礙等級認定之。
