The amount claimed by the Insurer from the liability Insurer shall be limited to the balance remaining from the insured amount of the liability insurance, after deducting the portion payable to the victim.The portion payable to the victim under the liability insurance provided in the preceding paragraph does not include the medical benefits under this Insurance.

保險人向責任保險人請求之償付金額，以該責任保險之保險金額扣除應給付受害人部分後之餘額為限。
