National Health Insurance Act Article 75
When drug expenses applied for by contracted medical care institutions exceed the amount designated by the Competent Authority, contracts for all transactions with pharmaceutical firms shall be signed to define rights and responsibilities, except if the purchase of drugs is for rare diseases or other special cases.The Competent Authority shall meet with the Fair Trade Commission, Executive Yuan, to draft the standard contracts for the written contract in the preceding paragraph and other recorded or unrecorded matters.

保險醫事服務機構申報之保險藥品費用逾主管機關公告之金額者，其與藥商間之藥品交易，除為罕見疾病用藥採購或有主管機關公告之特殊情事外，應簽訂書面契約，明定其權利義務關係。
主管機關應會同行政院公平交易委員會訂定前項書面契約之定型化契約範本及其應記載及不得記載事項。
