Regulations for Tuna Longline Fishing Vessels Proceeding to the Indian Ocean for Fishing Operation Article 8
Any fishing vessel that applies for an Indian Ocean Permit for the following year shall meet Article 6-1 and the following conditions:(1) Large scale longliners:i. For bigeye tuna group:(i) It has obtained from the competent authority a bigeye tuna group permit for the current year.(ii) It is a newly built fishing vessel which has received the replacement qualification from a loss fishing vessel belonging to the bigeye tuna group or the bigeye tuna group concurrently conducting part-time fishing for albacore or yellowfin tuna.ii. For albacore tuna group:(i) It has obtained from the competent authority an albacore tuna group permit for the current year.(ii) It is a newly built fishing vessel which has received the replacement qualification from a loss fishing vessel belonging to the albacore tuna group.(iii) It was a fishing vessel originally authorized to operate in the Indian Ocean with a longline fishery fishing license and approved to operate non-tuna longline fishery under fisheries cooperation with any foreign country.(2) Small scale longliners:i. For frozen yellowfin tuna group:(i) It has obtained from the competent authority an frozen yellowfin tuna group permit for the current year.(ii) It is a newly built fishing vessel which has received the replacement qualification from a loss fishing vessel belonging to the frozen yellowfin tuna group.ii. For general group:(i) It has previously obtained a frozen yellowfin tuna group or general group permit.(ii) It is a newly built fishing vessel which has received the replacement qualification from a loss fishing vessel belonging to the frozen yellowfin tuna group or general group.Any part-time carrier vessel authorized by the competent authority to operate in the Pacific Ocean shall not apply for any of the distant water fisheries permits as referred to in the preceding paragraph, and revocation shall be made if the permit has been granted.

申請次年度赴印度洋作業許可之漁船，應符合第六條之一規定及下列條件之一：
一、大釣船：
（一）大目鮪組：1.當年度取得主管機關作業許可之大目鮪組漁船。
2.承受滅失時為大目鮪組或大目鮪兼營長鰭鮪或黃鰭鮪組之汰建資格所新建造之漁船。
（二）長鰭鮪組：1.當年度取得主管機關作業許可之長鰭鮪組漁船。
2.承受滅失時為長鰭鮪組漁船之汰建資格所新建造之漁船。
3.原經許可在印度洋作業且領有延繩釣漁業執照，並經核准參加對外漁業合作經營非鮪延繩釣漁業。
二、小釣船：
（一）冷凍黃鰭鮪組：1.當年度取得主管機關作業許可之冷凍黃鰭鮪組漁船。
2.承受滅失時為冷凍黃鰭鮪組漁船之汰建資格所新建造之漁船。
（二）一般組：1.曾取得冷凍黃鰭鮪組或一般組之遠洋作業許可。
2.承受滅失時為冷凍黃鰭鮪組或一般組漁船之汰建資格所新建造之漁船。
經主管機關許可之太平洋兼營運搬船不得申請前項作業許可，已取得者應予廢止。
一、大釣船：
（一）大目鮪組：1.當年度取得主管機關作業許可之大目鮪組漁船。
2.承受滅失時為大目鮪組或大目鮪兼營長鰭鮪或黃鰭鮪組之汰建資格所新建造之漁船。
（二）長鰭鮪組：1.當年度取得主管機關作業許可之長鰭鮪組漁船。
2.承受滅失時為長鰭鮪組漁船之汰建資格所新建造之漁船。
3.原經許可在印度洋作業且領有延繩釣漁業執照，並經核准參加對外漁業合作經營非鮪延繩釣漁業。
二、小釣船：
（一）冷凍黃鰭鮪組：1.當年度取得主管機關作業許可之冷凍黃鰭鮪組漁船。
2.承受滅失時為冷凍黃鰭鮪組漁船之汰建資格所新建造之漁船。
（二）一般組：1.曾取得冷凍黃鰭鮪組或一般組之遠洋作業許可。
2.承受滅失時為冷凍黃鰭鮪組或一般組漁船之汰建資格所新建造之漁船。
經主管機關許可之太平洋兼營運搬船不得申請前項作業許可，已取得者應予廢止。
