Regulations for Tuna Longline Fishing Vessels Proceeding to the Indian Ocean for Fishing Operation Article 11
For any fishing vessel applying for a distant water fisheries permit of the frozen yellowfin tuna group, the competent authority shall decide the priority in accordance with the following provisions:(1) First priority: fishing vessels that were previously authorized by the competent authority as the frozen yellowfin tuna group in the Indian Ocean and have not lost such qualification; or fishing vessels that are newly built and receive the replacement qualification from fishing vessels belonging to the frozen yellowfin tuna group in the Indian Ocean.(2) Second priority: fishing vessels that were previously authorized by the competent authority as the frozen yellowfin tuan group in the Pacific Ocean and have not lost such qualification.(3) Third priority: fishing vessels that are authorized as small scale longliners of the general group in the Indian Ocean in the current year.In the event that the number of fishing vessels applying in accordance with the preceding paragraph exceeds the limit, the competent authority shall draw lots to decide the priority in an equitable and impartial manner.In the event that the number of fishing vessels obtaining distant water fisheries permits of the frozen yellowfin tuna group does not reach the limit of the current year, in addition to filling vacancies in accordance with the priority prescribed in the preceding two paragraphs, the competent authority may announce in due course to accept applications, notwithstanding the application deadline prescribed in Article 9.Where a distant water fisheries operator of a fishing vessel belonging to the general group has obtained documentary proof of waiving the replacement qualification of a fishing vessel belonging to the frozen yellowfin tuna group, he/she may be given priority in obtaining operating qualification as a fishing vessel of the frozen yellowfin tuna group, not subject to the priority stipulated in paragraph 1, and shall retain the quota originally obtained pursuant to Article 24, paragraph 7.

申請冷凍黃鰭鮪組作業許可之漁船，主管機關應依下列順位排定優先順序：
一、第一順位：前經主管機關許可為印度洋冷凍黃鰭鮪組且未喪失該組作業資格之漁船，或承受滅失時為印度洋冷凍黃鰭鮪組漁船之汰建資格所新建造之漁船。
二、第二順位：前經主管機關許可為太平洋冷凍黃鰭鮪組且未喪失該組作業資格之漁船。
三、第三順位：當年度經許可為印度洋一般組之小釣船。
前項申請漁船船數超過船數限額時，由主管機關以公開公平方式抽籤排定順序。
取得作業許可之冷凍黃鰭鮪組漁船船數，未達當年度船數限額時，除依前二項規定之順位依次遞補外，主管機關得另行公告受理申請，不受第九條申請期限規定之限制。
一般組漁船經營者取得已放棄冷凍黃鰭鮪組漁船汰建資格之證明文件者，得優先取得冷凍黃鰭鮪組漁船作業資格，不受第一項申請順位規定之限制，並保留原依第二十四條第七項規定取得之配額。
