Regulations for Fishing Vessels Conducting Squid Jigging Fishery Article 39-1
Any of the following circumstances shall be imposed with punishment(s) in accordance with Article 36 of the Act:(1) Any transshipment is conducted without approval, or in the case of transshipping catches caught from the north Pacific Ocean under force majeure, the transshipment application is not filed before the completion of the concerned transshipment, in violation of Article 31, paragraph 1 or 2.(2) Any transshipment is conducted not within the approved timeframe or range, in violation of item i of Article 31, paragraph 3, subparagraph (1); item i of Article 31, paragraph 3, subparagraph (2); or item i of Article 31, paragraph 3, subparagraph (3). Notwithstanding, the circumstances as stipulated in paragraph 2, subparagraph (3) and (5) of this Article are not subject to this provision.(3) Any landing is conducted without approval, in violation of Article 36, paragraph1.(4) Any landing is conducted not within the approved timeframe, in violation of Article 36, paragraph 2. Notwithstanding, the circumstances as stipulated in paragraph 2, subparagraph (11) of this Article are not subject to this provision.(5) Any inspection for verification of the catch is evaded, obstructed, or refused, in violation of Article 38, paragraph 1; or the requirements as stipulated in Article 38, paragraph 2 are not complied with.Any of the following circumstances shall be imposed with punishment(s) in accordance with Article 41 of the Act:(1) Any carrier vessel of the Republic of China transships with, refuels, or supplies any fishing vessel not on the approved vessels list of the NPFC or the list of authorized vessels of the SPRFMO, or any fishing vessel that has altered its name or registration number, in violation of Article 27, paragraph 1.(2) Any fishing vessel engage in refueling or supply within the Convention area of the NPFC or SPRFMO with any fishing vessel not on the approved vessels list of the NPFC or on the list of authorized vessels of the SPRFMO, or any fishing vessel that has altered its name or registration number, in violation of Article 27, paragraph 2.(3) Any fishing vessel or carrier vessel authorized to transship in Chienchen Fishing Harbor, Siaogang Linhai New Residential Quarter Fishing Harbor, Cijin Fishing Harbor, or Pier No. 41 of Kaohsiung Port conducts such activity after the timeframe approved, in violation of item i of Article 31, paragraph 3, subparagraph (1); item i of Article 31, paragraph 3, subparagraph (2); or item i of Article 31, paragraph 3, subparagraph (3).(4) Any fishing vessel or carrier vessel that transships catches caught from the eastern Pacific Ocean fishing area fails to notify the competent authority of the cancellation of the transshipment within three days after the approved period for transshipment, in violation of item iii of Article 31, paragraph 3, subparagraph (1).(5) Any transshipment of catches caught from the north Pacific Ocean fishing area, the notification of which is not filed via the NPFC Transshipment Record, is conducted between 24 hours to 72 hours after the approved time for transshipment or between 20 nautical miles to 50 nautical miles from the approved location for transshipment, in violation of item i of Article 31, paragraph 3, subparagraph (2).(6) Any fishing vessel or carrier vessel that transships catches caught from the north Pacific Ocean fishing area fails to submit the transshipment notification to the NPFC Secretariat no later than 24 hours before the estimated time for transshipment, or in the case of force majeure, before the completion of the transshipment, in violation of item iii of Article 31, paragraph 3, subparagraph (2).(7) Any fishing vessel or carrier vessel that transships catches caught from the north Pacific Ocean fishing area fails to notify the competent authority or the NPFC Secretariat of the cancellation of the transshipment within three days after the approved period for transshipment, in violation of item iv of Article 31, paragraph 3, subparagraph (2).(8) Transshipment is conducted when the ALC on board is signal-lost and has not been repaired, in violation of Article 34.(9) Transshipment declaration(s) for the transshipment(s) conducted within the current trip is not placed onboard, in violation of Article 35, paragraph 1.(10) The transshipment declaration is not submitted to the competent authority before the deadline, or in the case of transshipping catches caught from the north Pacific Ocean fishing area, the transshipment declaration is not submitted to the NPFC Secretariat before the deadline, in violation of Article 35, paragraph 2.(11) A fishing vessel that is under the circumstances stipulated in the proviso clause of Article 36, paragraph 2 lands in Chienchen Fishing Harbor, Siaogang Linhai New Residential Quarter Fishing Harbor, Cijin Fishing Harbor, or Pier No. 41 of Kaohsiung Port after the timeframe approved.(12) The landing declaration is not submitted before the deadline, in violation of Article 37.

有下列情形之一者，應依本條例第三十六條規定處罰：
一、違反第三十一條第一項或第二項規定，未經許可從事轉載，或轉載北太平洋漁區所捕漁獲物之漁船遇不可抗力時未於轉載完成前提出轉載申請。
二、違反第三十一條第三項第一款第一目、第二款第一目或第三款第一目規定，未於許可轉載期間或地點範圍轉載。
但不包含第二項第三款及第五款情形。
三、違反第三十六條第一項規定，未經許可從事卸魚。
四、違反第三十六條第二項規定，未於許可卸魚期間內卸魚。
但不包含第二項第十一款情形。
五、違反第三十八條第一項規定，規避、妨礙或拒絕漁獲查核，或未配合辦理同條第二項規定事項。
有下列情形之一者，應依本條例第四十一條規定處罰：
一、我國籍運搬船違反第二十七條第一項規定，與未列名在NPFC船舶註冊名單，或未列名在SPRFMO船舶名單、塗改船名或統一編號之漁船，進行轉載、加油或補給。
二、漁船違反第二十七條第二項規定，於NPFC或SPRFMO公約水域，與未列名在NPFC船舶註冊名單，或未列名在SPRFMO船舶名單、塗改船名或統一編號之漁船進行加油或補給三、屬經許可於前鎮、小港臨海新村、旗津漁港或高雄港四十一號碼頭從事港內轉載之漁船或運搬船，違反第三十一條第三項第一款一目、第二款第一目或第三款第一目規定，於許可轉載期間後，始從事港內轉載。
四、違反第三十一條第三項第一款第三目規定，轉載東太平洋漁區所捕漁獲物，因故取消而未於許可轉載期間屆滿後三日內向主管機關通報。
五、違反第三十一條第三項第二款第一目本文規定，轉載北太平洋漁區所捕漁獲物，且未使用NPFC線上轉載申報系統申報者，於許可轉載時間後逾二十四小時至七十二小時內或逾許可轉載地點方圓二十浬至五十浬範圍內進行轉載。
六、違反第三十一條第三項第二款第三目規定，轉載北太平洋漁區所捕漁獲物，未於預定轉載時間二十四小時前，或遇不可抗力時未於轉載完成前，將轉載漁獲申報表報送NPFC秘書處。
七、違反第三十一條第三項第二款第四目規定，轉載北太平洋漁區所捕漁獲物，因故取消而未於許可轉載期間屆滿後三日內向主管機關或NPFC秘書處通報。
八、違反第三十四條規定，於船位回報器斷訊未修復前進行轉載。
九、違反第三十五條第一項規定，船上未備置當航次從事轉載之轉載漁獲物確認書。
十、違反第三十五條第二項規定，未於規定期限內報送轉載漁獲物確認書予主管機關，或轉載北太平洋漁區所捕漁獲物，未於規定期限內報送NPFC秘書處。
十一、屬第三十六條第二項但書之漁船，許可卸魚期間後，於前鎮、小港臨海新村、旗津漁港或高雄港四十一號碼頭卸魚。
十二、違反第三十七條規定，未於規定期限內提交卸魚聲明書。
一、違反第三十一條第一項或第二項規定，未經許可從事轉載，或轉載北太平洋漁區所捕漁獲物之漁船遇不可抗力時未於轉載完成前提出轉載申請。
二、違反第三十一條第三項第一款第一目、第二款第一目或第三款第一目規定，未於許可轉載期間或地點範圍轉載。
但不包含第二項第三款及第五款情形。
三、違反第三十六條第一項規定，未經許可從事卸魚。
四、違反第三十六條第二項規定，未於許可卸魚期間內卸魚。
