Regulations for Fishing Vessels Conducting Squid Jigging Fishery Article 31
Any squid jigging fishing vessel and carrier vessel that intends to conduct transshipment shall respectively apply for the approval from the competent authority before the transshipment.Any (distant water fisheries) operator or captain applying for the approval as referred to in the preceding paragraph shall fill in the transshipment notification (as shown in Appendix 5 for the eastern Pacific Ocean fishing area and southwestern Atlantic Ocean fishing area, Appendix 5-1 for the north Pacific Ocean fishing area) and submit it to the competent authority no later than three days before the estimated date for transshipment. In case that the last day for filing the application is a day-off, the application shall be made on the working day before the day-off. Notwithstanding such provision, in case of force majeure that prevents a vessel from applying by the deadline for transshipping catches caught from the north Pacific Ocean fishing area, the application shall be filed before the completion of the concerned transshipment.Squid jigging fishing vessels and carrier vessels approved by the competent authority to transship shall comply with the following requirements:(1) In the case of transshipping catches caught from the eastern Pacific Ocean fishing area:i. The transshipment may be conducted within 72 hours after the approved time for transshipment, but shall only be conducted within 50 nautical miles of the approved location for transshipment.ii. The (distant water fisheries) operator or the captain concerned shall, 24 hours before the estimated time for transshipment, fill in the transshipment notification (format as shown in Appendix 5) and apply to the competent authority for the change of transshipment time and/or location, if the transshipment cannot be conducted within the timeframe or range as referred to in the preceding item. Any application made after the timeframe shall be denied. In case that other matter(s) is also changed in addition to the transshipment time and/or location, a new application shall be made in accordance with the preceding paragraph.iii. If an approved transshipment is cancelled, the concerned operators or captains of the squid jigging fishing vessel and carrier vessel shall notify the competent authority within three days after the approved period for transshipment.(2) In the case of transshipping catches caught from the north Pacific Ocean fishing area:i. The transshipment may be conducted within 24 hours after the approved time for transshipment, but shall only be conducted within 20 nautical miles of the approved location for transshipment. Notwithstanding such provision, from 24 July 2024 onward, for any transshipment notification made to the NPFC Secretariat via the NPFC Transshipment Record, such transshipment may be conducted within 72 hours after the approved time for transshipment, but shall only be conducted within 50 nautical miles of the approved location for transshipment.ii. The (distant water fisheries) operator or the captain concerned shall, 24 hours before the estimated time for transshipment, fill in the transshipment notification (as shown in Appendix 5-1) and apply to the competent authority for the change of transshipment time and/or location, if the transshipment cannot be conducted within the timeframe or range as referred to in the preceding item. Any application made after the timeframe shall be denied. In case that other matter(s) is also changed in addition to the transshipment time and/or location, a new application shall be made in accordance with the preceding paragraph.iii. When filing an application in accordance with the preceding paragraph or item, the (distant water fisheries) operator or captain concerned shall simultaneously, or no later than 24 hours before the estimated time for transshipment, submit the transshipment notification (as shown in Appendix 5-1) to the NPFC Secretariat. In case of force majeure that prevents a vessel from submitting such notification within the timeframe, the notification shall be submitted before the completion of the transshipment.iv. If an approved transshipment is cancelled, the concerned operators or captains of the squid jigging fishing vessel and carrier vessel shall notify the competent authority and the NPFC Secretariat within three days after the approved period for transshipment.(3) In the case of transshipping catches caught from the southwestern Atlantic Ocean fishing area:i. The transshipment may be conducted on the approved date for transshipment or within three days before or five days after the approved date. Notwithstanding such provision, the actual transshipment date shall not be within two days after the application date.ii. The (distant water fisheries) operator or the captain concerned may, before the end of the timeframe, apply for the change of transshipment date, if the transshipment cannot be conducted within the timeframe as referred to in the preceding item. The transshipment shall only be conducted after obtaining the approval from the competent authority. 魷釣漁船或運搬船從事漁獲物轉載前，應分別向主管機關申請許可。
經營者或船長為前項之申請，應填具轉載漁獲申報表（東太平洋漁區及西南大西洋漁區如附件五、北太平洋漁區如附件五之一），最遲於預定轉載日前三日，向主管機關提出。
申請日之末日為例假日時，應提前於例假日前一工作日提出。
但轉載北太平洋漁區所捕漁獲物之漁船，遇不可抗力因素無法依期限申請轉載者，應於轉載完成前提出。
經主管機關許可轉載之魷釣漁船及運搬船，應依下列規定辦理：
一、轉載東太平洋漁區所捕漁獲物：
（一）得於許可轉載時間起七十二小時內從事漁獲物轉載，且須於許可轉載地點方圓五十浬範圍內進行。
（二）未能於前目所定期間或地點範圍進行轉載者，經營者或船長申請變更轉載時間、地點，應於該預定轉載時間二十四小時前，填具轉載漁獲申報表（同附件五）向主管機關申請變更轉載時間、地點；未於時限內申請變更者，不予同意；申請變更事項除轉載時間、地點外，尚包含其他資訊者，應重新依前項規定辦理。
（三）經許可之轉載行為如因故取消，魷釣漁船、運搬船之經營者或船長應於許可轉載期間屆滿後三日內向主管機關通報。
二、轉載北太平洋漁區所捕漁獲物：
（一）得於許可轉載時間起二十四小時內從事漁獲物轉載，且須於許可轉載地點方圓二十浬範圍內進行。
但自中華民國一百十三年七月二十四日起，使用NPFC線上轉載申報系統向NPFC秘書處申報轉載漁獲申報表者，得於許可轉載時間起七十二小時內從事漁獲物轉載，且須於許可轉載地點方圓五十浬範圍內進行。
（二）未能於前目所定期間或地點範圍進行轉載者，經營者或船長申請變更轉載時間、地點，應於該預定轉載時間二十四小時前，填具轉載漁獲申報表（同附件五之一）向主管機關申請變更轉載時間、地點；未於時限內申請變更者，不予同意；申請變更事項除轉載時間、地點外，尚包含其他資訊者，應重新依前項規定辦理。
（三）經營者或船長依前項或前目規定提出申請時，應同時或最遲於預定轉載時間二十四小時前將轉載漁獲申報表（同附件五之一）報送NPFC秘書處。
但漁船遇不可抗力因素無法依期限報送者，應於轉載完成前報送。
（四）經許可之轉載行為如因故取消，魷釣漁船、運搬船之經營者或船長應於許可轉載期間屆滿後三日內向主管機關及NPFC秘書處通報。
三、轉載西南大西洋漁區所捕漁獲物：
（一）得於許可轉載日或其前三日或後五日內，從事漁獲物轉載。
但實際轉載日不得於轉載申請日後二日內。
（二）未能於前目所定期間進行轉載者，經營者或船長得於轉載期間屆滿前申請變更轉載日期，並經主管機關同意變更後始得為之；未於轉載期間屆滿前申請變更者，不予同意。
經營者或船長為前項之申請，應填具轉載漁獲申報表（東太平洋漁區及西南大西洋漁區如附件五、北太平洋漁區如附件五之一），最遲於預定轉載日前三日，向主管機關提出。
