Regulations for the Issuance of Building Permit and Fishing License of Fishing Vessel Article 9-1
Any fishery operator of trawl or gillnet fishery may apply for exchanging the fishery type with a tuna longline or longline fishing vessel of the same size and level. This provision shall apply vice versa.In case that the concerned replacement tonnages are unequal for the exchange of the fishery type as referred to in the preceding paragraph, the following provisions shall apply to reserve or complement the replacement tonnage:(1) In case that the replacement tonnage of an existing trawl or gillnet fishing vessel is greater than that of an existing tuna longline or longline fishing vessel:i. The concerned fishery operator of trawl or gillnet fishery may apply for reserving the surplus replacement tonnage from the trawl or gillnet fishery, the validity period of which shall be one year from the date of approval.ii. The concerned fishery operator of tuna longline or longline fishery is waived from complementing the shortfall of tuna longline or longline replacement tonnage. In case of future replacement, the size and level of the replacement qualification shall be the same as the ones of the original tuna longline or longline fishing vessel.(2) In case that the replacement tonnage of an existing trawl or gillnet fishing vessel is less than that of an existing tuna longline or longline fishing vessel:i. The concerned fishery operator of trawl or gillnet fishery shall complement the shortfall in the trawl or gillnet replacement tonnage.ii. The concerned fishery operator of tuna longline or longline fishery may apply for reserving the surplus tuna longline or longline replacement tonnage, the validity period of which shall be one year from the date of approval.

漁業人之漁業種類為拖網或刺網者，得申請與鮪延繩釣或延繩釣相同規模級別漁船互換經營漁業種類；反之亦然。
前項互換經營漁業種類，其漁船汰舊噸數不相等時，依下列規定辦理保留或補足汰舊噸數：
一、拖網或刺網現有漁船之汰舊噸數大於鮪延繩釣或延繩釣現有漁船者：
（一）拖網或刺網漁業人，得申請保留差額之拖網或刺網漁業種類賸餘汰舊噸數，效期自核准之日起保留一年。
（二）鮪延繩釣或延繩釣漁業人，免補足不足之鮪延繩釣或延繩釣汰舊噸數；其日後汰建時，汰建資格之規模級別與原鮪延繩釣或延繩釣漁船之汰建資格相同。
二、拖網或刺網現有漁船之汰舊噸數小於鮪延繩釣或延繩釣現有漁船者：
（一）拖網或刺網漁業人，應補足不足之拖網或刺網汰舊噸數。
（二）鮪延繩釣或延繩釣漁業人，得申請保留差額之鮪延繩釣或延繩釣漁業種類賸餘汰舊噸數，效期自核准之日起保留一年。
前項互換經營漁業種類，其漁船汰舊噸數不相等時，依下列規定辦理保留或補足汰舊噸數：
一、拖網或刺網現有漁船之汰舊噸數大於鮪延繩釣或延繩釣現有漁船者：
（一）拖網或刺網漁業人，得申請保留差額之拖網或刺網漁業種類賸餘汰舊噸數，效期自核准之日起保留一年。
