The Plant Variety and Plant Seed Act Article 38

Any person who believes that a variety right falls within any of the circumstances set forth in Paragraphs 1 or 2 of thepreceding Article may submit to the central competent authority a request for revocation or annulment of such variety right together with a written statement explaining the reasons for the request and any supporting evidence, provided that only the holder of the right to apply for such variety right may request revocation under Subparagraph 2 of Paragraph 1 of the preceding Article.If a variety right is revoked in accordance with Paragraph 1 of the preceding Article, such variety right shall be deemed to be nonexistent from the beginning.
