Regulations For Revenues, Expenditures, Safeguard And Utilization Of The Employment Security Fund Article 5
The purposes of the Fund are as follows:1. Promoting employment:(1) To reinforce the implementation of vocational training and the provision of the employment service information.(2) To reinforce the implementation of the employment security and the employment promotion.(3) Entrepreneurship assistance and innovation development.(4) Unemployment assistance.(5) Subsidies and allowances for employers who promote employment security.(6) Administering skills certification, skill competitions and occupational competency standards.2. Improvement of worker welfare:(1) To reinforce the protection of rights and interests related to decent work.(2) To enhance workers’ awareness and establish diverse mechanisms to safeguard labor rights.(3) To provide assistance for specific and vulnerable groups.(4) To promote workplace safety and health and raise awareness of occupational hazards.3. Managing the employment of foreign workers:(1) To manage the employment and protect the rights of foreign workers.(2) Liaison with source countries of foreign workers.(3) To handle employment permit related matters for foreign workers.4. To subsidize Municipal City and County (City) authorities to process matters related to the employment promotion, the improvement of the welfare for workers and the management of foreigners working in the territories of the Republic of China.5. The expenditures of the Labor Rights Fund.6. The expenditures of fund management and administration.The Municipal City and County (City) authorities shall allocate matching funds when applying therefor in accordance with Subparagraph 4 of the preceding paragraph. The regulations governing such subsidies shall be separately prescribed by the Competent Authority.The Labor Rights Fund in accordance with Subparagraph 5 of Paragraph 1 shall be used for the following purposes:1. Legal aid in labor litigations.2. Subsidies for necessary living expenses during labor litigations.3. All other related assistance in the protections and support of labor rights.The funds required for handling Subparagraph 6 of Paragraph 1 shall be budgeted with a ceiling of 4.5% of the total appropriations for the fund in the current fiscal year.

本基金之用途如下：
一、促進國民就業：
（一）加強職業訓練及就業資訊事項。
（二）加強就業安定及就業促進事項。
（三）創業協助及創新發展事項。
（四）失業輔助事項。
（五）獎助雇主配合推動就業安定事項。
（六）辦理技能檢定、技能競賽及職能基準事項。
二、提升勞工福祉：
（一）強化尊嚴勞動之權益保障事項。
（二）增進勞工意識及建構多元保障勞動權益事項。
（三）扶助特定及弱勢對象事項。
（四）促進職場安全健康及提升危害意識之認知事項。
三、處理外國人聘僱管理事務：
（一）外國人聘僱管理及權益保障事項。
（二）與外國人來源國業務聯繫事項。
（三）外國人聘僱許可事項。
四、補助直轄市及縣（市）政府辦理有關促進國民就業、提升勞工福祉及外國人在中華民國境內工作管理事項。
五、勞工權益基金支出。
六、基金管理及行政管理支出。
直轄市及縣（市）政府申請前項第四款經費補助時，應編列配合款；其經費補助規定，由主管機關另定之。
第一項第五款所定勞工權益基金之用途如下：
一、勞工訴訟之法律扶助。
二、勞工訴訟期間必要生活費用之補助。
三、其他相關勞工權益扶助事項。
辦理第一項第六款所需經費，以當年度本基金用途預算總額百分之四點五為編列上限。
