Labor Pension Act Article 31
When an employer fails to contribute to the pension on a monthly basis or in full for an employee in accordance with the Act and causes damages to the employee, the employee shall claim damages from the employer.The right for an employee to file the claim referred to in the preceding paragraph shall be forfeit if such a right is not exercised within five years from the date of resignation.

雇主未依本條例之規定按月提繳或足額提繳勞工退休金，致勞工受有損害者，勞工得向雇主請求損害賠償。
