Labor Insurance Act Article 65
Survivors' pension benefits and survivors' allowance shall be payable to the entitled survivors(s) according to the order prescribed below:1. spouse, son and daughter;2. father and/or mother;3. grandfather and grandmother;4. grandson and granddaughter;5. brother(s) and sister(s).Survivors listed on the rear order as stipulated in the previous paragraph are not entitled to apply for survivor's pension benefits or survivor's allowance if survivors listed on the front still exist.Should the survivors listed in first order are all disqualified for the survivor's pension payments or having one of the following conditions when there is no survivor qualified in the same order, the survivors in the second order could claim for survivor's pension benefit:1. die while claiming the survivor pension benefit;2. nowhere to be found or are in overseas;3. submit a claiming waiver;4. don't submit an application within one year when qualified for claiming benefits.When the survivor in the first order of previous paragraph claims the benefits or re-conform to the claiming criteria, the benefit would not be granted to other survivors and the survivors in the first order could claim the benefits; however, if the benefits are already granted to the survivors in the second order, the benefits would not be reissued to the survivors in the first order.

受領遺屬年金給付及遺屬津貼之順序如下：
一、配偶及子女。
二、父母。
三、祖父母。
四、孫子女。
五、兄弟、姊妹。
前項當序受領遺屬年金給付或遺屬津貼者存在時，後順序之遺屬不得請領。
前項第一順序之遺屬全部不符合請領條件，或有下列情形之一且無同順序遺屬符合請領條件時，第二順序之遺屬得請領遺屬年金給付：
一、在請領遺屬年金給付期間死亡。
二、行蹤不明或於國外。
三、提出放棄請領書。
四、於符合請領條件起一年內未提出請領者。
前項遺屬年金嗣第一順序之遺屬主張請領或再符合請領條件時，即停止發給，並由第一順序之遺屬請領；但已發放予第二順位遺屬之年金不得請求返還，第一順序之遺屬亦不予補發。
