Labor Insurance Act Article 20-1
Where it is confirmed after an insured person terminates the insurance scheme that he/she got a kind of occupational disease during the valid period of the insurance, he/she may claim the occupational permanent disability benefits.The regulations of the objects of the above-mentioned payment, kinds of occupational diseases, determination procedure, calculation of the amount payable and other related affairs shall be prescribed by the competent central authority.

被保險人退保後，經診斷確定於保險有效期間罹患職業病者，得請領職業災害保險失能給付。
前項得請領失能給付之對象、職業病種類、認定程序及給付金額計算等事項之辦法，由中央主管機關定之。
