Standards for Disability Benefits of Labor Insurance Article 4
Workers evaluated according to this Act are incapable of work for the rest of their lives means they conform to one of the following conditions:1. It refers to workers having a disability described in the attached table as “loss of work capacity for the rest of their lives”.2. The insured applying for disability pensions shall conduct an individual professional evaluation stating that they have lost more than 70% work capacity and therefore cannot return to the workplace according to the provisions prescribed in Paragraph 2 of Article 54-1 of this Act.Individual professional evaluation referred to in the preceding Subparagraph 2 shall be comprehensively evaluated of work capacity in accordance with injury percentage for the whole person, earning capacity regarding future work, occupation and the age of the insured.

本條例所定經評估為終身無工作能力者，指符合下列情形之一：
一、失能狀態經審定符合本標準附表所定失能狀態列有「終身無工作能力」者。
二、被保險人為請領失能年金給付，依本條例第五十四條之一第二項規定，經個別化之專業評估，其工作能力減損達百分之七十以上，且無法返回職場者。
前項第二款所定個別化之專業評估，依被保險人之全人損傷百分比、未來工作收入能力、職業及年齡，綜合評估其工作能力。
