Mass Rapid Transit Act Article 46
1. The operation organization of a mass rapid transit system shall be responsible for personal death or injury of passengers, and damage or loss caused by trains or other accidents.2. The operation organization of a mass rapid transit system shall pay for, at its discretion, consolation or medical aid subsidy for death or injury victims, even when the operation organization is not responsible for the train accident referred to the preceding paragraph. However, the above mentioned circumstance does not apply if the accident is caused by the victim intentionally.3. The regulations for the payment for consolation and medical aid subsidy referred to the proceding paragraph shall be prescribed by the central competent authority.

大眾捷運系統營運機構，因行車及其他事故致旅客死亡或傷害，或財物毀損喪失時，應負損害賠償責任。
前項事故之發生，非因大眾捷運系統營運機構之過失者，對於非旅客之被害人死亡或傷害，仍應酌給卹金或醫療補助費。
但事故之發生係出於被害人之故意行為者，不予給付。
前項卹金及醫療補助費發給辦法，由中央主管機關定之。
