Mass Rapid Transit Act Article 39

The operation organization of a mass rapid transit system shall inform the local and central competent authorities immediately when serious accidents take place, and report the situation and handling of the situation for ratification whenever necessary. Collective reports on general traffic incidents and abnormal events shall also be submitted monthly.The local competent authority may require the responsible person or relevant supervisory personnel of the operation organization of a mass rapid transit system to explain the content of the reports stipulated in the preceding paragraph.The operation organization of a mass rapid transit system shall establish contingency plans for accidents and abnormal events, carry out regular drills in accordance with the contingency plans, and conduct reviews for improvement.The local competent authority may inspect the content of the contingency plans established by the operation organization of a mass rapid transit system, as well as the details of regular and irregular drills. If it finds any deficiencies, it may order the operation organization of a mass rapid transit system to make improvements within a given time period.The operation organization of a mass rapid transit system shall cooperate with the local government in the operating region to establish a coordination platform for disaster prevention and response, and it shall regularly convene coordination meetings on disaster prevention and response operations.When the operation organization of a mass rapid transit system reports serious accidents pursuant to Paragraph 1, it shall also report them to the Taiwan Transportation Safety Board in accordance with the Transportation Occurrences Investigation Act.
