Aircraft Flight Operation Regulations Article 261-1
For operations where communication equipment is required to meet an Required communication performance (RCP) specification for performance-based communication (PBC), an airplane shal1 comply with the preceding article and ensure the following requirements specified:1. Be provided with communication equipment which will enable it to operate in accordance with the prescribed Required communication performance (RCP) specification(s).2. Have information relevant to the airplane Required communication performance (RCP) specification capabilities listed in the flight manual or other airplane documentation approved by the State of Design or CAA.3. Have information relevant to the airplane Required communication performance (RCP) specification capabilities included in the MEL.For operations where an Required communication performance (RCP) specification for performance-based communication (PBC) has been prescribed, the operator shall ensure the following procedure has established and documented, and be approved by CAA:1. Normal and abnormal procedures, including contingency procedures.2. Flight crew qualification and proficiency requirements, in accordance with appropriate Required communication performance (RCP) specifications.3. A training programme for relevant personnel consistent with the intended operations.4. Appropriate maintenance procedures to ensure continued airworthiness, in accordance with appropriate Required communication performance (RCP) specifications.The aircraft which was approved by CAA according to the preceding paragraph, the operator shall ensure the following:1. Receiving the reports of observed communication performance issued by monitoring programmes from international organization.2. Taking immediate corrective action for individual aircraft identified in such reports as not complying with the Required communication performance (RCP) specification(s).The operator implement performance-based communication (PBC) operation, shall comply with the international flight standards as approved and adopted by CAA.

航空器飛航於以性能為基礎之通信之空域或航路時，除應符合前條規定外，並應符合下列規定：
一、裝置符合通信性能規範需求之通信裝備。
二、航空器所具備之通信性能需求能力相關資訊應明列於飛航手冊，並經航空器設計國民航主管機關或民航局核准。
三、於最低裝備需求手冊中訂定通信性能規範需求能力相關規定。
航空器使用人應建立以下程序，報請民航局核准後，始得於以性能為基礎之通信之空域或航路從事飛航作業：
一、正常、異常及緊急程序。
二、依據適用之通信性能規範需求訂定飛航組員資格及適職要求。
三、依飛航作業需求訂定相關人員之訓練計畫。
四、依據適用之通信性能規範需求訂定維修程序，確保航空器持續適航。
經民航局依前項規定核准之航空器，應遵守下列規定：
一、接收通信監控國際組織通知之通信性能偏差報告。
二、對通信性能偏差之航空器採取有效之立即改善措施。
航空器使用人執行以性能為基礎之通信作業，應依民航局核定採用之國際飛航標準辦理。
一、裝置符合通信性能規範需求之通信裝備。
二、航空器所具備之通信性能需求能力相關資訊應明列於飛航手冊，並經航空器設計國民航主管機關或民航局核准。
