Aircraft Flight Operation Regulations Article 246

An aircraft shall be equipped with a flight recorder capable of recording essential information of a flight, in order to serve the purpose of aircraft accident investigation. The specifications of a flight recorder shall be in compliance with the international flight standards as approved and adopted by CAA. However, an aircraft may be exempted by the approval of CAA under the following conditions:1. The manufacturer of which provides no technical bulletin for such modifications, and if there is no possibility to obtain the STC issued by our nation, the United States, EASA or the state of design to perform such modifications.2. The aircraft will be deregistered before 30 September 2005.3. Free balloon category.The flight recorder shall be activated before flight, and shall not be deactivated in flight. However, in the case of an aircraft accident or aircraft serious incident, the flight recorder shall be deactivated when the flight ends, and shall not be re-activated until the flight data has been retrieved. This requirement shall apply to aircraft incident where CAA so requires.An operator shall perform routine operational check of the flight recorder system to ensure the continuous serviceability of the recorders.
