Where damage to passenger or freight was the result of willful or major neglect or wrongdoing on the part of the aircraft operator or consignor, liabilities will not be limited to the compensation standards prescribed herein.The aircraft operator or consignor shall be equally liable for any wilful or major misconduct by their employees or representative in the execution of duties.

航空器使用人或運送人因故意或重大過失致生客貨之損害者，其賠償責任不受本辦法賠償額標準之限制。
航空器使用人或運送人對其受僱人或代理人執行職務時之故意或重大過失，應與自己之故意或重大過失負同一責任。
