Medical Examination Standards for Airmen Article 39
An airman who failed to pass the Medical Exam may, in addition to seeking for the remedy provided under Article 8 hereof, submit to CAA an application with relevant documents within 30 days for the Waiver on Medical Exam from the date on which the notification of the determination of the failure is received. After CAA evaluation, recognizes through the working experience or cured by medical therapy，will not affect the safety of the flight, such fail items may be waived.While The applicant request the Waiver on Medical Exam，the reconsideration of determination period should be suspended.Upon the reason for suspension of such period of time specified in the preceding paragraph ceases to exist, the period of time shall resume accruing taking into account of the time having accrued before such suspension.

體檢受檢人之體檢結果經評定不符合規定之標準者，除依第八條辦理外，受檢人或所屬單位得自收受不合標準通知書之日起三十日內，檢附申請書及相關資料向民航局申請缺點免計。
如經民航局鑑定後，認為在行使職務時，藉由該項專業技能之實際工作經驗或經完整治療後，不致影響飛航安全者，對其不合標準之部分，准予缺點免計。
航空人員申請缺點免計者，其覆議時效停止計算。
前項時效停止，自停止原因消滅之日起，與停止前已經過之期間，一併計算。
如經民航局鑑定後，認為在行使職務時，藉由該項專業技能之實際工作經驗或經完整治療後，不致影響飛航安全者，對其不合標準之部分，准予缺點免計。
