The Commercial Port Law Article 4
For the appointment of an International Commercial Port, the MOTC shall report to the Executive Yuan for approval and promulgation. The MOTC shall consult with the Ministry of Interior Affairs (the MOIA) and relevant authorities to delimit a commercial port area before reporting to the Executive Yuan for approval.For the appointment of a Domestic Commercial Port, the MOTC shall report to the Executive Yuan for future reference and promulgation. The MOTC shall consult with the MOIA and relevant authorities for purpose of commercial port area delimiting before granting an approval.

國際商港之指定，由主管機關報請行政院核定後公告之；商港區域之劃定，由主管機關會商內政部及有關機關後，報請行政院核定之。
國內商港之指定，由主管機關報請行政院備查後公告之；商港區域之劃定，由主管機關會商內政部及有關機關後核定之。
