Enforcement Rules of the Patent Act Article 14

The so-called “a person ordinarily skilled in the art” in Article 22, Article 26, and Article 27 of the Act shall mean a person having general knowledge and ordinary skill in the art of the invention at the time of filing.In the preceding paragraph, the time of filing shall mean the priority date where priority is claimed pursuant to Paragraph 1, Article 28 or Paragraph 1, Article 30 of the Act.
