Withdrawal of invalidation actionAn invalidation action may be withdrawn by the requester before a decision concerned has been rendered. However, if the patentee has already submitted a response, such withdrawal shall be consented to by the patentee.The Specific Patent Agency shall notify the patentee of the withdrawal of an invalidation action. If the patentee raises no objection within ten (10) days after the notice has been served, it shall be deemed that the patentee has consented to such withdrawal.

舉發人得於審定前撤回舉發申請。
但專利權人已提出答辯者，應經專利權人同意。
專利專責機關應將撤回舉發之事實通知專利權人；自通知送達後十日內，專利權人未為反對之表示者，視為同意撤回。
