Effects of design patent rightUnless otherwise provided in this Act, the patentee of a design patent has the exclusive right to prevent others from exploiting the design or similar design(s) without the patentee’s consent.The extent of the protection conferred by a design patent shall be determined by the drawing(s), with the description serving as a reference.
