Trademark Act Article 102
Transitional provision for abolishment of defensive registration systemWith respect to a defensive trademark, defensive service mark, defensive collective mark or defensive certification mark which is already registered before the enforcement of the articles of this Act amended on April 29, 2003, the provisions in effect at the time of publication of registration of the said trademark or mark shall govern; rights of such trademark or mark shall be extinguished unless the proprietor of such trademark or mark applies for changing such trademark or mark into an independent one.

本法中華民國九十二年四月二十九日修正之條文施行前，已註冊之防護商標、防護服務標章、防護團體標章或防護證明標章，依其註冊時之規定；於其專用期間屆滿前，應申請變更為獨立之註冊商標或標章；屆期未申請變更者，商標權消滅。
