Transfer of Sentenced Persons Act Article 2
The transfer of sentenced persons is subject to the treaties, which Republic of China (hereinafter referred to as “ROC”) has signed with the Transferring States. The provisions of the Act herein shall be applicable only when there is no treaty or they are not regulated in treaties. Where matters are not regulated in this Act, the Criminal Code of ROC, Code of Criminal Procedure, Juvenile Delinquency Act and other relevant provisions of the laws shall govern.

移交受刑人依我國與移交國簽訂之條約；無條約或條約未規定者，依本法；本法未規定者，適用刑法、刑事訴訟法、少年事件處理法及其他相關法律之規定。
